Evatex Threatens Legal Action Against GACL Over Terminated Audit Contract

Evatex Logistics Limited has issued a strong warning to the Ghana Airports Company Limited (GACL), threatening legal action over the abrupt termination of a revenue assurance audit agreement.

In a letter dated July 28, 2025, and signed by its legal representatives, K-Archy & Company, Evatex expressed “utter dismay” at GACL’s intention to terminate the contract, which was signed on December 4, 2024, and took effect from August 27, 2024. The firm insists the decision was taken in “bad faith” and labeled it as “unreasonable.”

The company’s legal counsel, Kwame Acheampong Boateng, Esq., stated that Evatex had already made significant financial investments into the agreement, including tailor-made infrastructure for the GACL. The total investment reportedly amounts to $64.6 million.

“Our client considers the intention to terminate the said contract as actuated by bad faith and unreasonableness,” the letter reads.

Evatex maintains that it had already begun executing its assignment under the contract and had submitted reports to the GACL as part of its obligations. It has now instructed its lawyers to demand that GACL withdraw its termination letter within seven days of receiving the legal notice.

The company also made clear that if GACL fails to reverse its decision within the stipulated time, it will proceed with legal action to seek redress and recover its investments.

“In view of the foregoing, and in the spirit of seeking an amicable settlement of the matter, our client instructs us to inform you to withdraw the said letter within seven days,” the letter emphasized. “We have our client’s full instruction to institute an action to vindicate its rights and seek reliefs including, but not limited to, its capital investments.”

The development raises fresh questions about procurement, contractual obligations, and due process at state-owned enterprises, as industry watchers await GACL’s response.
